Senator Mattera Proposes Legislation to Combat Squatting Epidemic in New York State

Senator Mattera has introduced a comprehensive legislative proposal aimed at addressing the rising epidemic of squatting in New York State. The senator emphasized the urgent need for action, stating, "It is overwhelmingly obvious that the laws of this state fall way short of addressing the squatter issue effectively."

To combat this issue, Senator Mattera's four-part legislative proposal includes a groundbreaking statute (S.8867) that would empower law enforcement to swiftly evict individuals from residential properties based on a homeowner's sworn complaint, without court involvement. The senator highlighted the importance of this bill, stating, "With this bill, our police will have the tools they need to right this wrong."

Furthermore, the proposed legislation shifts the burden to squatters to prove their rightful possession in court after eviction and ensures substantial civil protections for those wrongfully removed. Senator Mattera emphasized that the initiatives prioritize the rights of New York homeowners over squatters and trespassers, marking a significant step forward in protecting property rights. The senator emphasized, "Real property rights are deemed paramount under the law."

In addition to the cornerstone bill, the anti-squatting package includes measures such as redefining the definition of occupant to exclude squatters, clarifying criminal trespass laws related to squatting, and excluding squatters from certain self-help eviction remedies.

Senator Mattera urged residents to join the fight against the squatting epidemic and called on the Assembly, Senate, and Governor Hochul to support the proposed legislative changes. The senator concluded by stating, "Please join me in fighting the squatting epidemic and call on the Assembly and Senate along with Governor Hochul to change New York State law to protect all of our residents!"
