New York State Senator Dean Murray has introduced legislation aimed at amending the penal law to address the use of masks and face coverings during criminal activities. The bill, designated as S.9891, seeks to establish a new crime called aggravated concealment of identity. Under this proposed law, penalties for misdemeanors and felonies would be elevated by one degree if it is proven that the perpetrator committed the offense while wearing a mask or face covering.
Senator Murray emphasized the importance of this legislation in addressing the issue of criminals using masks to conceal their identities. "I know there has been quite a bit of controversy over when and where people have the 'right' to wear a face covering or mask, but what I'm trying to make clear with this bill is that NO ONE has the right to conceal his or her identity for the purpose of committing a crime," said NYS Senator Dean Murray, representing the 3rd District.
Murray further stated his hope that the bill would act as a deterrent for those considering hiding their faces to commit crimes anonymously. "I'm hoping this legislation will serve as a deterrent to those thinking of hiding their face in order to commit anonymous crimes and will allow victims to seek justice when hurt by criminals who are emboldened by the current lack of consequences in state law,” he added.
Currently, New York state law does not include provisions specifically targeting individuals who intentionally conceal their identities during criminal acts. "This bill will fill the gap in state law," stated Senator Murray.
The bill is currently under consideration in the Senate Committee on Rules.
