Suffolk DA's crackdown on retail theft yields results

Suffolk County District Attorney Raymond A. Tierney has announced the outcomes of the Retail Protection Partnership, a program launched in October 2023 to address rising shoplifting rates in New York State and across the nation. The initiative facilitates collaboration between merchants and law enforcement to prosecute repeat offenders effectively.

District Attorney Tierney emphasized the importance of protecting local businesses and their employees from theft. "We must protect our merchants and the jobs that come from retail businesses," he stated. He added that retail theft leads to increased costs for consumers and destabilizes neighborhoods, warning that offenders will face jail time rather than leniency.

Suffolk County Police Acting Commissioner Robert Waring highlighted the partnership's role in reducing shoplifting incidents: “The Retail Protection Partnership has taken a major step in curtailing the behavior of shoplifters.” This model aims to benefit both retailers and consumers while underscoring law enforcement's commitment to tackling retail theft.

Ben Dugan, CVS Executive Director of Central Investigations, expressed satisfaction with being part of this effort: “Our partnerships with local law enforcement are integral to identifying and dismantling organized retail crime networks.” Melissa O’Connor, President and CEO of the Retail Council, also praised District Attorney Tierney’s efforts: “Not only does this send a message to those who continue to steal from local stores, it furthers the ultimate goal of safer communities.”

The partnership was formed after discussions with retailers revealed challenges posed by recent bail reforms. Shoplifters reportedly boasted about quick releases post-arrest due to these changes. The partnership now includes major retailers such as Target Corporation, Lowe’s, Home Depot, Ulta, Marshalls, Stop & Shop, Walgreens, Macy’s, CVS, TJX companies, and Burlington.

A notable strategy employed by Suffolk County prosecutors is "aggregation," where multiple misdemeanor thefts are combined into a felony charge if committed by the same offender. This approach aligns with new legislation enacted in July 2024. An example cited involved a defendant charged with Grand Larceny after committing multiple petty thefts at a Walmart store.
