Push for reform in NY's guardianship laws gains momentum

In light of several high-profile guardianship abuse cases, including public figures like Wendy Williams and investigations by New York Attorney General Letitia James into guardianship providers, Senator Anthony Palumbo is advocating for reform in New York's Guardianship system. He aims to achieve this through the passage of Karilyn’s Law, which seeks to ensure that family members and friends can visit loved ones under guardianship or conservatorship.

Karilyn’s Law is named after Karilyn Montanti, a senior citizen who was reportedly denied visitation rights with her family while under guardianship. The legislation aims to prevent guardians or care managers from arbitrarily terminating these rights and isolating individuals in involuntary guardianships. It also ensures that if visitation rights are denied, those affected can request an evidentiary hearing within ten days.

Senator Palumbo stated, “New York’s guardianship system needs to be overhauled to protect some of the State’s most vulnerable residents from forced isolation and provide them with the ability to see loved ones and friends.” He highlighted that denial of visitation is a significant issue within the current system.

Christine Montanti, Karilyn's daughter and a Guardianship Advocate, shared her distress: “I have been living a complete nightmare for several years as my mother is in a constant state of torture and I am powerless to save her." She expressed gratitude towards Senator Palumbo for his efforts on behalf of vulnerable individuals.

Illana Musikar added personal testimony about being blocked from contacting her mother: "If this can happen to me and my family this can happen to anyone."

Jonathan Farley recounted his mother's traumatic experience: “My mother screamed you are breaking my arm as she was dragged out of her home against her will.” He urged for the passage of Karilyn’s Law so others do not suffer similar fates.

Senator George Borrello emphasized the need for reform: "New York’s guardianship system is in dire need of reform to protect our most vulnerable citizens from exploitation and abuse."

Concluding on this note, Senator Palumbo reiterated the importance of passing Karilyn's Law as a necessary step toward protecting families navigating the challenges posed by the current guardianship system.
