Rep. Nick LaLota of Suffolk County, New York, has voted in favor of the No Rogue Rulings Act, a bill introduced by Rep. Darrell Issa from California's 48th district. The legislation aims to restrict the power of individual District Court judges to issue nationwide injunctions that affect national security decisions made by the President.
"District Court judges should not have the unilateral authority to override a President's national security decisions with nationwide implications. Today, I joined my colleagues in passing Representative Darrell Issa's 'No Rogue Rulings Act,' which aims to properly limit their jurisdiction,” said LaLota. “This legislation is crucial for ensuring that our national security is guided by elected officials accountable to the people, not by any one of the 700 unelected District Court judges. I voted to pass this act because it reinforces the balance of power essential to our democracy."
The No Rogue Rulings Act seeks to amend existing law to prevent U.S. District Court judges from granting injunctions that apply beyond the parties directly involved in a particular case. Under the proposed changes, injunctions would only affect the party seeking relief and non-parties represented under the Federal Rules of Civil Procedure.
This legislative move comes in the wake of a decision by Federal Judge James Boasberg in March 2025. Judge Boasberg upheld an order that blocked the Trump administration from using the Alien Enemies Act of 1798 to deport individuals suspected of gang affiliations without providing them the opportunity for due process. The judge highlighted the right of those labeled as gang members to challenge their designations before any deportation action.
